Residential Purchase

At York Solicitors, we intend to make your home purchase as smooth as possible, making this experience stress-free. Our dedicated team at the Conveyancing department, supported by support staff, always thrives to achieve your target completion date.

We usually discuss our fee at the initial stage of your transaction and elaborate in our client care letter. The table below is for your basic information. Please note that the fee below may change depending on the nature of the transaction. We can offer you a personalised estimate at the initial stage.

Further Additional Costs

We will charge additional fees in the following circumstances :

  • A legal title is defective or part of the property is unregistered
  • Your purchase is part of a back to back transaction.
  • The property is a new build
  • The property is less than 10 years old
  • You need to exchange within 2 weeks of instructing us
  • You need to complete within 2 weeks of instructing us
  • You purchase the property through auction

LEASEHOLD PURCHASE FEES There may be additional costs that may be payable regarding the apportionments of your Ground Rent/Service Charge payable on your property. We will endeavour to let you know as soon as possible.
ADDITIONAL CONVEYANCING SEARCHES PLEASE NOTE, DEPENDING ON YOUR TRANSACTION AND ACCORDING TO THE REQUIREMENTS OF THE LENDER, WE MAY HAVE TO CARRY OUT ADDITIONAL SEARCHES, WHICH WE DISCUSS WITH YOU AT EACH STAGE.

Key Stages

  • Taking instructions from you. We usually receive instructions directly from you or through estate agents.
  • Inviting you to attend our office. At this stage, we will collect your passport copy, bank statements and residence proof
  • Open file and prepare client care letter pack and obtain an initial deposit
  • If we act for lender we normally receive your offer to our portal or by post.
  • Start correspondence with seller`s solicitors to receive contract pack
  • Apply for property searches and other initial searches
  • Prepare enquiries to seller`s solicitors
  • Once all the enquiries are satisfactorily replied to and if we are satisfied with the search results and other issues overall in your transaction, we will report to you and the lender. At this stage, we will invite you to our office to sign the documents.
  • We will carry out pre-completion searches before exchanging contracts
  • We will submit certificate of title to lender to obtain mortgage funds
  • If satisfied we will  proceed to exchange contracts with your authority and authority from lender .
  • Attend to completion on agreed date by both parties.
  • Attend to post completion matters including filing SDLT and land registry application
  • Once the title is registered with the land registry  we will send you the registration completion documents and send to the lender if applicable. We will then commence steps to close your matter.

Time Scale

A typical residential purchase takes about 10-12 weeks . This may vary  due to complexity of the transaction where more time  may be required.

  • Dealing with enquiries from buyers solicitors if we receive any.
  • Once the exchange date is agreed obtain redemption statements form your lender/lenders  if your property is subject to charges/mortgages notices etc.
  • If the enquiries are resolved , on the agreement of buyers solicitors and with your authority , review the file for exchange and completion.
  • Upon completion redeem all the charges and mortgages on your property
  • Transfer balance of sale proceeds to your account after checking the account details with you.
  • Attend to post completion matters and move to close your file.

Key Stages

  • We receive your mortgage offer through brokers or from you directly
  • We invite you to attend our office. At this stage we will check your ID documents , bank statements and residency proof
  • Open file, prepare client care letter and obtain initial deposit from you
  • Start correspondence with lender directly or with their solicitors if applicable
  • Obtain redemption statements for all the charges/mortgages registered in the title of your property
  • Agree completion date with lender or their solicitors and obtain funds from them
  • Upon completion we redeem all the charges/mortgages on your property
  • Transfer balance funds safely to your account

Time Scale

Most remortgage matters are completed within 03 weeks from issuance of mortgage offer .

A commercial property transaction will include but not limited to the following:

  • Advising an Individual with respect to obtaining a new business, whether it be a first-time business venture or an addition to a portfolio
  • Acquisition of a New Lease and negotiating the Heads of Terms
  • Assignment of an Existing Lease/Business
  • Lease Extensions – Whether you are the Landlord wishing to object to a Lease Renewal or alternatively a Tenant wishing to renew your Lease.

  • Purchasing a Freehold/Leasehold Commercial Property
  • Premises Licence Applications.
  • Rent Review Disputes
  • Matters in relation to service Charges, Schedule of Dilapidations or Forfeiture issues.

Our fees cover all the work required to complete the purchase of your commercial property, including dealing with registration at the Land Registry and dealing with the payment of Stamp Duty Land Tax (Stamp Duty) if the property is in England, or Land Transaction Tax (Land Tax) if the property is in Wales.

We will charge additional fees in following circumstances:

  • A legal title is defective, or part of the property is unregistered
  • Your purchase is part of back-to-back transaction.
  • Where your mortgage lender instructs its own solicitor.
  • The property is a new build or in the course of construction.
  • Where there is a breach of a restriction e.g. preventing alterations or change of use of the property.
  • Where the property lacks the rights required for ordinary use and enjoyment e.g. access or the usual services.
  • Where your lease purchase includes the purchase of a share of the freehold.
  • Where a lease extension is involved.
  • Where freeholder consent for any reason may be required.
  • Shared ownership transactions.
  • Missing or absentee landlords.
  • Where the lease is defective e.g. lack of repairing covenants covering each part of the building.
  • The property is less than 10 years old
  • You need to exchange within less than 3 weeks of instructing us

Disbursements

Disbursements are costs related to your matter that are payable to third parties, such as search fees. We handle the payment of the disbursements on your behalf to ensure a smoother process. The disbursements which we anticipate will apply are set out separately below. This list is not exhaustive and other disbursements may apply.

  • We will obtain a redemption statement from the lender to redeem the mortgage (if applicable)
  • If satisfied, we will proceed to exchange contracts with your authority (if applicable).
  • Attend to completion on agreed date by both parties.
  • Attend to post completion matters including mortgage redemption and transfer of proceeds of sale to you.

We will then commence steps to close your matter.
